6. Procedura rozpatrywania reklamacji
6.1. Sprzedający ponosi wobec Klienta będącego konsumentem odpowiedzialność za brak zgodności towaru z umową na zasadach określonych w ustawie z dnia 30 maja 2014 r. o prawach konsumenta.
6.2. W przypadku stwierdzenia braku zgodności towaru z umową Klient może złożyć reklamację do Sprzedającego.
6.3. Reklamację można złożyć:
- drogą elektroniczną na adres poczty elektronicznej Sprzedającego,
- pisemnie na adres Sprzedającego wskazany w pkt 1.1 Regulaminu.
6.4. Reklamacja powinna, w miarę możliwości, zawierać:
- imię i nazwisko Klienta,
- dane pozwalające zidentyfikować zamówienie lub zakup,
- opis stwierdzonego problemu lub braku zgodności towaru z umową,
- datę stwierdzenia problemu,
- żądanie Klienta związane z reklamacją.
Podanie powyższych informacji ma na celu ułatwienie i przyspieszenie rozpatrzenia reklamacji. Brak któregokolwiek z tych elementów nie może stanowić podstawy do odmowy rozpatrzenia reklamacji.
6.5. W przypadku braku zgodności towaru z umową Klient może żądać doprowadzenia towaru do zgodności z umową poprzez jego naprawę lub wymianę.
6.6. Jeżeli naprawa lub wymiana są niemożliwe albo wymagałyby nadmiernych kosztów, a także w przypadkach określonych przepisami prawa, Klient może żądać obniżenia ceny albo odstąpić od umowy.
6.7. Sprzedający może odmówić naprawy lub wymiany towaru, jeżeli doprowadzenie towaru do zgodności z umową w sposób wybrany przez Klienta jest niemożliwe albo wymagałoby nadmiernych kosztów, z uwzględnieniem okoliczności przewidzianych przepisami prawa.
6.8. Jeżeli rozpatrzenie reklamacji wymaga dostarczenia reklamowanego towaru Sprzedającemu, Sprzedający uzgodni z Klientem sposób jego przekazania. Koszty związane z reklamacją, w tym koszty transportu, ponosi Sprzedający na zasadach określonych w obowiązujących przepisach prawa.
6.9. Sprzedający rozpatruje reklamację i udziela odpowiedzi w terminie 14 dni od dnia jej otrzymania, zgodnie z obowiązującymi przepisami prawa.
6.10. O sposobie rozpatrzenia reklamacji Klient zostanie poinformowany w sposób odpowiadający formie złożenia reklamacji lub na wskazany przez Klienta adres kontaktowy.
6.11. Jeżeli reklamacja zostanie uznana, Sprzedający podejmie odpowiednie działania w celu doprowadzenia towaru do zgodności z umową albo dokona zwrotu odpowiedniej części lub całości zapłaconej ceny – stosownie do żądania Klienta i obowiązujących przepisów prawa.
6.12. Sprzedający nie udziela dodatkowej gwarancji na sprzedawane produkty, chyba że informacja o udzieleniu gwarancji została wyraźnie zamieszczona przy konkretnym produkcie. Brak gwarancji nie ogranicza ustawowych praw Klienta wynikających z braku zgodności towaru z umową.
6.13. Postanowienia niniejszego rozdziału nie ograniczają praw Klienta będącego konsumentem wynikających z bezwzględnie obowiązujących przepisów prawa.
6. Complaint Procedure
6.1. The Seller shall be liable to a Customer who is a consumer for any lack of conformity of the goods with the contract, in accordance with the provisions of the Polish Act of 30 May 2014 on Consumer Rights.
6.2. If the Customer finds that the goods are not in conformity with the contract, the Customer may submit a complaint to the Seller.
6.3. A complaint may be submitted:
- electronically, to the Seller's e-mail address,
- in writing, to the Seller's address indicated in Section 1.1 of these Terms and Conditions.
6.4. Where possible, the complaint should include:
- the Customer's first and last name,
- information identifying the order or purchase,
- a description of the identified problem or lack of conformity of the goods with the contract,
- the date on which the problem was identified,
- the Customer's request concerning the complaint.
Providing the above information is intended to facilitate and expedite the processing of the complaint. The absence of any of these elements shall not constitute grounds for refusing to consider the complaint.
6.5. In the event of a lack of conformity of the goods with the contract, the Customer may request that the goods be brought into conformity with the contract by means of repair or replacement.
6.6. If repair or replacement is impossible or would require excessive costs, as well as in other cases provided for by applicable law, the Customer may request a reduction in price or withdraw from the contract.
6.7. The Seller may refuse to repair or replace the goods if bringing the goods into conformity with the contract in the manner chosen by the Customer is impossible or would require excessive costs, taking into account the circumstances provided for by applicable law.
6.8. If processing the complaint requires the defective or non-conforming goods to be delivered to the Seller, the Seller shall agree with the Customer on the method of returning or providing the goods. Costs related to the complaint, including transportation costs, shall be borne by the Seller in accordance with applicable law.
6.9. The Seller shall consider the complaint and provide a response within 14 days from the date of receipt of the complaint, in accordance with applicable law. Failure to respond within this period shall have the legal effect provided for by applicable law.
6.10. The Customer shall be informed of the outcome of the complaint in a manner corresponding to the form in which the complaint was submitted or at the contact address provided by the Customer.
6.11. If the complaint is accepted, the Seller shall take appropriate action to bring the goods into conformity with the contract or shall refund the appropriate part or all of the price paid, as applicable to the Customer's request and in accordance with applicable law.
6.12. The Seller does not provide an additional commercial guarantee for the products sold, unless information concerning such a guarantee is expressly provided for a particular product. The absence of a commercial guarantee does not affect the Customer's statutory rights arising from a lack of conformity of the goods with the contract.
6.13. The provisions of this section do not limit the rights of a Customer who is a consumer under mandatory provisions of applicable law.
