REGULAMIN SKLEPU INTERNETOWEGO EMILANDIA.PL
1. Postanowienia ogólne
1.1. Sklep internetowy działający pod adresem emilandia.pl, zwany dalej „Sklepem”, prowadzony jest przez EMI Barbara Ambrożewicz, prowadzącą działalność gospodarczą pod firmą EMI Barbara Ambrożewicz, z adresem prowadzenia działalności: ul. Klonowa 36, 83-330 Lniska, NIP: 5841382899, zwaną dalej „Sprzedającym”.

1.2. Niniejszy Regulamin określa zasady korzystania ze Sklepu, w szczególności zasady składania zamówień, zawierania i wykonywania umów sprzedaży, dokonywania płatności i dostawy produktów, składania reklamacji, korzystania z prawa odstąpienia od umowy oraz zasady świadczenia usług drogą elektroniczną.
1.3. Regulamin jest udostępniany Klientowi nieodpłatnie na stronie internetowej Sklepu w sposób umożliwiający jego pozyskanie, odtworzenie, zapisanie i wydrukowanie. Regulamin jest również udostępniany Klientowi przed złożeniem zamówienia.
1.4. Regulamin stosuje się do Klientów będących konsumentami oraz do przedsiębiorców dokonujących zakupów w Sklepie.
Postanowienia dotyczące praw konsumentów stosuje się również do osoby fizycznej zawierającej umowę bezpośrednio związaną z jej działalnością gospodarczą, jeżeli z treści tej umowy wynika, że nie posiada ona dla tej osoby charakteru zawodowego, wynikającego w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej.
1.5. Klient może kontaktować się ze Sprzedającym za pośrednictwem poczty elektronicznej, telefonicznie lub pisemnie, korzystając z danych kontaktowych wskazanych w pkt 1.1 Regulaminu.
1.6. Informacje dotyczące produktów zamieszczone na stronie internetowej Sklepu, w szczególności ich opisy, zdjęcia i ceny, stanowią zaproszenie do zawarcia umowy w rozumieniu art. 71 Kodeksu cywilnego, chyba że z treści danej informacji wyraźnie wynika inaczej.
1.7. Zdjęcia produktów zamieszczone w Sklepie mają charakter poglądowy. Ze względu na ręczne wykonanie lub ręczne zdobienie produktów, poszczególne egzemplarze mogą nieznacznie różnić się od produktów przedstawionych na zdjęciach, w szczególności w zakresie ułożenia wzoru, ornamentu lub odcienia.
2. Usługi świadczone drogą elektroniczną
2.1. Sprzedający świadczy drogą elektroniczną usługi umożliwiające korzystanie ze Sklepu, w szczególności:
a) przeglądanie zawartości Sklepu,
b) korzystanie z formularza zamówienia,
c) w przypadku udostępnienia takiej funkcji – założenie i korzystanie z konta Klienta.
2.2. Założenie konta Klienta jest dobrowolne i nie jest konieczne do złożenia zamówienia, o ile Sprzedający udostępnia możliwość dokonania zakupu bez rejestracji.
2.3. W celu założenia konta Klient podaje dane wymagane przez formularz rejestracyjny. Konto jest prowadzone nieodpłatnie przez czas nieoznaczony.
2.4. Klient może w każdej chwili zrezygnować z konta i zażądać jego usunięcia, wysyłając odpowiednie żądanie na adres poczty elektronicznej Sprzedającego.
2.5. Formularz zamówienia umożliwia Klientowi złożenie zamówienia na produkty dostępne w Sklepie. Korzystanie z formularza zamówienia jest nieodpłatne i ma charakter jednorazowy.
2.6. Do korzystania ze Sklepu niezbędne jest urządzenie z dostępem do Internetu oraz aktualna przeglądarka internetowa umożliwiająca prawidłowe wyświetlanie stron internetowych. W przypadku składania zamówienia konieczne jest również posiadanie aktywnego adresu poczty elektronicznej.
2.7. Klient zobowiązany jest korzystać ze Sklepu zgodnie z prawem, niniejszym Regulaminem oraz dobrymi obyczajami, a w szczególności nie dostarczać treści o charakterze bezprawnym i nie podejmować działań mogących zakłócić funkcjonowanie Sklepu.
2.8. Sprzedający informuje, że korzystanie z Internetu wiąże się z typowymi zagrożeniami, takimi jak złośliwe oprogramowanie, wirusy, próby nieuprawnionego dostępu do urządzenia lub konta oraz spam. Klient powinien stosować aktualne oprogramowanie zabezpieczające oraz zachować podstawowe zasady bezpieczeństwa podczas korzystania z Internetu.
2.9. Reklamacje dotyczące usług świadczonych drogą elektroniczną można składać drogą elektroniczną lub pisemnie na dane kontaktowe wskazane w pkt 1.1 Regulaminu.
2.10. Sprzedający rozpatruje reklamację dotyczącą usług świadczonych drogą elektroniczną w terminie 14 dni od dnia jej otrzymania i informuje Klienta o sposobie jej rozpatrzenia.
3. Składanie zamówień i zawarcie umowy
3.1. Sklep umożliwia składanie zamówień przez 24 godziny na dobę, 7 dni w tygodniu, z zastrzeżeniem przerw technicznych lub innych przyczyn niezależnych od Sprzedającego.
3.2. W celu złożenia zamówienia Klient:
a) wybiera produkt oraz jego ilość,
b) dodaje produkt do koszyka,
c) wypełnia formularz zamówienia, podając dane niezbędne do realizacji zamówienia,
d) wybiera sposób dostawy i płatności,
e) zapoznaje się z Regulaminem oraz wymaganymi informacjami,
f) potwierdza zamówienie poprzez użycie przycisku oznaczonego w sposób jednoznacznie wskazujący na obowiązek zapłaty, np. „Zamów i zapłać”.
3.3. Przed złożeniem zamówienia Klient otrzymuje informację o głównych cechach produktu, jego cenie, kosztach dostawy oraz łącznej cenie zamówienia.
3.4. Złożenie zamówienia stanowi ofertę zawarcia umowy sprzedaży produktu lub produktów objętych zamówieniem.
3.5. Po otrzymaniu zamówienia Sprzedający przesyła Klientowi wiadomość e-mail potwierdzającą jego otrzymanie.
3.6. Umowa sprzedaży zostaje zawarta z chwilą przesłania Klientowi wiadomości e-mail potwierdzającej przyjęcie zamówienia do realizacji, chyba że Sprzedający poinformuje Klienta o braku możliwości realizacji zamówienia.
3.7. Potwierdzenie zawarcia umowy zostaje przesłane Klientowi na podany przez niego adres e-mail na trwałym nośniku.
3.8. W przypadku braku możliwości realizacji całości lub części zamówienia Sprzedający niezwłocznie poinformuje o tym Klienta. Jeżeli zamówienie zostało opłacone, Sprzedający zwróci Klientowi otrzymaną płatność w zakresie, w jakim zamówienie nie może zostać zrealizowane.
3.9. Umowy zawierane za pośrednictwem Sklepu są zawierane w języku polskim.
4. Ceny i płatności
4.1. Ceny produktów prezentowane w Sklepie są cenami brutto i podawane są w złotych polskich (PLN).
4.2. Cena produktu nie obejmuje kosztów dostawy, chyba że przy produkcie wyraźnie wskazano inaczej.
4.3. Koszt dostawy jest podawany Klientowi przed złożeniem zamówienia. Łączna wartość zamówienia, obejmująca cenę produktów oraz koszt dostawy, jest przedstawiana Klientowi przed zawarciem umowy.
4.4. Cena produktu obowiązująca dla Klienta jest ceną wskazaną w Sklepie w chwili składania zamówienia.
4.5. Dostępne sposoby płatności są prezentowane Klientowi podczas składania zamówienia.
4.6. Sprzedający dokumentuje sprzedaż zgodnie z obowiązującymi przepisami prawa, wystawiając odpowiednio paragon fiskalny, fakturę lub inny wymagany dokument sprzedaży.
5. Dostawa i realizacja zamówienia
5.1. Dostawa produktów jest odpłatna, chyba że przy danym produkcie lub zamówieniu wskazano inaczej.
5.2. Produkty są dostarczane za pośrednictwem przewoźnika lub operatora pocztowego wybranego przez Klienta spośród sposobów dostawy dostępnych w Sklepie.
5.3. Dostawa realizowana jest na adres wskazany przez Klienta w formularzu zamówienia.
5.4. Dostawy realizowane są na terenie Rzeczypospolitej Polskiej. W przypadku zainteresowania dostawą poza terytorium Polski Klient powinien skontaktować się ze Sprzedającym przed złożeniem zamówienia w celu ustalenia możliwości realizacji dostawy oraz jej kosztu.
5.5. Standardowy czas realizacji zamówienia wynosi od 2 do 7 dni roboczych, chyba że przy konkretnym produkcie podano inny termin.
5.6. W przypadku produktów wykonywanych lub przygotowywanych na indywidualne zamówienie termin realizacji może być dłuższy. Termin taki jest podawany Klientowi przed zawarciem umowy.
5.7. W przypadku wyboru przez Klienta sposobu dostawy innego niż najtańszy zwykły sposób dostawy dostępny w Sklepie, w przypadku odstąpienia od umowy Sprzedający zwraca koszt dostawy wyłącznie do wysokości odpowiadającej najtańszemu zwykłemu sposobowi dostawy oferowanemu w Sklepie.
5.8. Sprzedający zaleca Klientowi sprawdzenie stanu przesyłki po jej otrzymaniu. W przypadku stwierdzenia uszkodzenia przesyłki wskazane jest sporządzenie protokołu szkody z przewoźnikiem. Brak sporządzenia takiego protokołu nie ogranicza praw Klienta wynikających z przepisów prawa.
6. Reklamacje – zgodność towaru z umową
6.1. Sprzedający ponosi wobec konsumenta odpowiedzialność za brak zgodności towaru z umową na zasadach określonych w ustawie z dnia 30 maja 2014 r. o prawach konsumenta.
Od 1 stycznia 2023 r. podstawą ustawowej odpowiedzialności Sprzedającego wobec konsumenta jest niezgodność towaru z umową, a nie rękojmia.
6.2. Towar jest zgodny z umową, jeżeli w szczególności odpowiada opisowi, rodzajowi, ilości, jakości, kompletności i funkcjonalności określonym w umowie oraz posiada cechy, których konsument może zasadnie oczekiwać, z uwzględnieniem charakteru towaru i publicznych zapewnień Sprzedającego.
6.3. W przypadku braku zgodności towaru z umową konsument może złożyć reklamację i żądać doprowadzenia towaru do zgodności z umową poprzez jego naprawę albo wymianę.
6.4. Jeżeli wystąpią przesłanki określone w ustawie, konsument może również żądać obniżenia ceny albo odstąpić od umowy. W szczególności uprawnienia te mogą przysługiwać, gdy Sprzedający odmówił naprawy lub wymiany, nie doprowadził towaru do zgodności z umową w rozsądnym czasie lub gdy towar nadal pozostaje niezgodny z umową. W przypadku istotnej niezgodności towaru z umową konsument może skorzystać z obniżenia ceny lub odstąpienia od umowy na zasadach określonych w ustawie.
6.5. Odpowiedzialność Sprzedającego z tytułu braku zgodności towaru z umową trwa co do zasady przez 2 lata od dnia wydania towaru konsumentowi, zgodnie z ustawą o prawach konsumenta.
6.6. Reklamację można złożyć:
a) pisemnie na adres Sprzedającego wskazany w pkt 1.1 Regulaminu,
b) za pośrednictwem poczty elektronicznej na adres:emilandia@emilandia.pl
6.7. Reklamacja powinna w miarę możliwości zawierać:
a) dane Klienta,
b) dane pozwalające zidentyfikować zamówienie lub zakup,
c) opis stwierdzonej niezgodności towaru z umową,
d) datę stwierdzenia niezgodności,
e) żądanie Klienta.
Podanie powyższych informacji ma na celu ułatwienie rozpatrzenia reklamacji, jednak ich brak nie może sam w sobie stanowić podstawy do odmowy rozpatrzenia reklamacji.
6.8. Sprzedający odpowiada na reklamację konsumenta w terminie 14 dni od dnia jej otrzymania. Brak odpowiedzi w tym terminie oznacza uznanie reklamacji w zakresie i na zasadach przewidzianych przepisami prawa.
6.9. W przypadku konieczności naprawy lub wymiany towaru Sprzedający ponosi koszty związane z doprowadzeniem towaru do zgodności z umową, w tym koszty transportu, przewozu, robocizny i materiałów, na zasadach określonych w przepisach prawa.
6.10. Sprzedający nie udziela dodatkowej gwarancji na produkty, chyba że przy konkretnym produkcie wyraźnie wskazano inaczej. Brak gwarancji nie ogranicza ustawowych praw Klienta wynikających z niezgodności towaru z umową.
7. Prawo odstąpienia od umowy
7.1. Klient będący konsumentem, który zawarł umowę na odległość, ma co do zasady prawo odstąpić od umowy w terminie 14 dni bez podawania przyczyny, na zasadach określonych w ustawie o prawach konsumenta.
7.2. Termin do odstąpienia od umowy wygasa po upływie 14 dni od dnia, w którym konsument wszedł w posiadanie towaru lub wskazana przez niego osoba trzecia, inna niż przewoźnik, weszła w posiadanie towaru.
7.3. Aby skorzystać z prawa odstąpienia od umowy, Klient powinien poinformować Sprzedającego o swojej decyzji w drodze jednoznacznego oświadczenia, np. wysłanego pocztą lub pocztą elektroniczną.
7.4. Klient może skorzystać z formularza odstąpienia od umowy stanowiącego załącznik do Regulaminu, jednak skorzystanie z formularza nie jest obowiązkowe.
7.5. Do zachowania terminu wystarczy wysłanie oświadczenia o odstąpieniu przed upływem 14-dniowego terminu.
7.6. W przypadku skutecznego odstąpienia od umowy Sprzedający zwraca Klientowi wszystkie otrzymane płatności, w tym koszt najtańszego zwykłego sposobu dostawy oferowanego w Sklepie.
7.7. Zwrot płatności następuje niezwłocznie, nie później niż w terminie 14 dni od dnia otrzymania przez Sprzedającego oświadczenia o odstąpieniu od umowy. Sprzedający może wstrzymać się ze zwrotem płatności do czasu otrzymania zwracanego towaru lub dostarczenia przez Klienta dowodu jego odesłania – w zależności od tego, które zdarzenie nastąpi wcześniej.
7.8. Zwrot płatności następuje przy użyciu takiego samego sposobu płatności, jakiego użył Klient, chyba że Klient wyraźnie zgodzi się na inny sposób zwrotu.
7.9. Klient powinien odesłać towar niezwłocznie, nie później niż w terminie 14 dni od dnia poinformowania Sprzedającego o odstąpieniu od umowy. Termin jest zachowany, jeżeli Klient odeśle towar przed jego upływem.
7.10. Bezpośrednie koszty zwrotu towaru ponosi Klient, chyba że Sprzedający zgodził się je ponieść lub obowiązek ich poniesienia wynika z przepisów prawa.
7.11. Klient odpowiada za zmniejszenie wartości towaru wynikające z korzystania z niego w sposób wykraczający poza zakres konieczny do stwierdzenia charakteru, cech i funkcjonowania towaru.
7.12. Wyłączenie prawa odstąpienia
Prawo odstąpienia od umowy nie przysługuje konsumentowi w przypadkach wskazanych w art. 38 ustawy o prawach konsumenta.
W szczególności prawo odstąpienia nie przysługuje w odniesieniu do umowy:
a) której przedmiotem jest towar nieprefabrykowany, wykonany według specyfikacji konsumenta lub służący zaspokojeniu jego zindywidualizowanych potrzeb;
b) której przedmiotem jest towar ulegający szybkiemu zepsuciu lub mający krótki termin przydatności do użycia;
c) której przedmiotem jest towar dostarczany w zapieczętowanym opakowaniu, którego po otwarciu nie można zwrócić ze względów związanych z ochroną zdrowia lub higieną, jeżeli opakowanie zostało otwarte po dostarczeniu;
d) której przedmiotem są towary, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami.
7.13. W przypadku produktów wykonywanych na indywidualne zamówienie, według wyboru Klienta, w szczególności w zakresie koloru, wzoru, ornamentu, wymiarów lub innych indywidualnych cech, prawo odstąpienia od umowy może być wyłączone, jeżeli produkt spełnia przesłanki wskazane w art. 38 pkt 3 ustawy o prawach konsumenta.
Informacja o wyłączeniu prawa odstąpienia od umowy jest przekazywana Klientowi przed zawarciem umowy.
8. Pozasądowe sposoby rozpatrywania reklamacji i dochodzenia roszczeń
8.1. Klient będący konsumentem ma możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń.
8.2. Konsument może w szczególności zwrócić się o pomoc do:
a) właściwego miejscowo powiatowego lub miejskiego rzecznika konsumentów,
b) organizacji społecznej, której ustawowym lub statutowym zadaniem jest ochrona konsumentów,
c) właściwego wojewódzkiego inspektoratu Inspekcji Handlowej,
d) podmiotu uprawnionego do prowadzenia postępowania w sprawie pozasądowego rozwiązywania sporów konsumenckich.
8.3. Szczegółowe informacje dotyczące dostępnych metod pozasądowego rozwiązywania sporów konsumenckich są dostępne na stronach internetowych Urzędu Ochrony Konkurencji i Konsumentów oraz właściwych instytucji.
8.4. Sprzedający informuje, że unijna platforma internetowego rozstrzygania sporów ODR została zlikwidowana. Od 20 marca 2025 r. nie można składać za jej pośrednictwem nowych skarg, a rozporządzenie ustanawiające platformę zostało uchylone ze skutkiem od 20 lipca 2025 r.
9. Dane osobowe i prywatność
9.1. Administratorem danych osobowych Klientów jest EMI Barbara Ambrożewicz, ul. Klonowa 36, 83-330 Lniska, NIP: 5841382899.
9.2. Dane osobowe Klientów są przetwarzane zgodnie z obowiązującymi przepisami prawa, w szczególności z Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 (RODO).
9.3. Podanie danych osobowych jest dobrowolne, jednak podanie danych niezbędnych do realizacji zamówienia jest konieczne do zawarcia i wykonania umowy sprzedaży.
9.4. Dane osobowe mogą być przetwarzane w szczególności w celu:
a) realizacji zamówień,
b) zawierania i wykonywania umów sprzedaży,
c) obsługi płatności,
d) realizacji dostawy,
e) rozpatrywania reklamacji i zwrotów,
f) realizacji obowiązków wynikających z przepisów prawa,
g) dochodzenia lub obrony przed roszczeniami.
9.5. Dane Klienta mogą być przekazywane podmiotom współpracującym ze Sprzedającym w zakresie niezbędnym do realizacji zamówienia, w szczególności firmom kurierskim, operatorom pocztowym, podmiotom obsługującym płatności oraz dostawcom usług informatycznych.
9.6. Szczegółowe informacje dotyczące przetwarzania danych osobowych, podstaw prawnych, okresów przechowywania danych oraz praw Klienta zawiera Polityka Prywatności dostępna na stronie internetowej Sklepu.
10. Postanowienia dotyczące przedsiębiorców
10.1. Postanowienia niniejszego rozdziału mają zastosowanie wyłącznie do Klientów niebędących konsumentami oraz do przedsiębiorców, do których nie stosuje się przepisów przyznających ochronę konsumencką.
10.2. W przypadku Klientów będących przedsiębiorcami Sprzedający może uzależnić realizację zamówienia od podania danych niezbędnych do wystawienia dokumentu sprzedaży.
10.3. W przypadku przedsiębiorców odpowiedzialność Sprzedającego z tytułu niezgodności towaru z umową podlega zasadom wynikającym z powszechnie obowiązujących przepisów prawa, z uwzględnieniem przepisów, które mogą mieć zastosowanie do danego rodzaju umowy.
10.4. W przypadku sporów z Klientem będącym przedsiębiorcą, właściwy będzie sąd określony zgodnie z przepisami powszechnie obowiązującego prawa.
11. Postanowienia końcowe
11.1. Sprzedający przestrzega praw konsumentów wynikających z bezwzględnie obowiązujących przepisów prawa. Postanowienia Regulaminu nie mają na celu wyłączenia ani ograniczenia praw konsumenta przysługujących mu na podstawie obowiązujących przepisów.
11.2. Jeżeli którekolwiek postanowienie Regulaminu okaże się nieważne lub bezskuteczne, pozostałe postanowienia pozostają w mocy, a w miejsce nieważnego lub bezskutecznego postanowienia stosuje się odpowiednie przepisy prawa.
11.3. Sprzedający może zmienić Regulamin z ważnych przyczyn, w szczególności w przypadku:
a) zmiany przepisów prawa,
b) zmiany sposobów płatności lub dostawy,
c) zmiany funkcjonalności Sklepu,
d) konieczności doprecyzowania postanowień Regulaminu.
11.4. Zmiany Regulaminu nie naruszają praw nabytych przez Klientów przed dniem wejścia w życie zmian.
11.5. Do umów zawartych przed zmianą Regulaminu stosuje się wersję Regulaminu obowiązującą w chwili zawarcia danej umowy, chyba że przepisy prawa stanowią inaczej.
11.6. Aktualna wersja Regulaminu jest dostępna na stronie internetowej Sklepu.
11.7. Regulamin wchodzi w życie z dniem [DATA].

POUCZENIE O PRAWIE ODSTĄPIENIA OD UMOWY
Prawo odstąpienia od umowy
Mają Państwo prawo odstąpić od niniejszej umowy w terminie 14 dni bez podania przyczyny.
Termin do odstąpienia od umowy wygasa po upływie 14 dni od dnia, w którym weszli Państwo w posiadanie rzeczy lub w którym osoba trzecia, inna niż przewoźnik i wskazana przez Państwa, weszła w posiadanie rzeczy.
Aby skorzystać z prawa odstąpienia od umowy, należy poinformować:

o swojej decyzji o odstąpieniu od umowy w drodze jednoznacznego oświadczenia, np. w formie pisma wysłanego pocztą lub wiadomości e-mail.
Mogą Państwo skorzystać z wzoru formularza odstąpienia od umowy, jednak nie jest to obowiązkowe.
Aby zachować termin do odstąpienia od umowy, wystarczy wysłać informację dotyczącą wykonania prawa odstąpienia przed upływem terminu do odstąpienia od umowy.
Skutki odstąpienia od umowy
W przypadku odstąpienia od umowy zwrócimy Państwu wszystkie otrzymane od Państwa płatności, w tym koszty dostarczenia rzeczy, z wyjątkiem dodatkowych kosztów wynikających z wybranego przez Państwa sposobu dostarczenia innego niż najtańszy zwykły sposób dostawy oferowany przez nas.
Zwrot płatności nastąpi niezwłocznie, a w każdym przypadku nie później niż 14 dni od dnia, w którym zostaliśmy poinformowani o Państwa decyzji o wykonaniu prawa odstąpienia od umowy.
Możemy wstrzymać się ze zwrotem płatności do czasu otrzymania rzeczy lub do czasu dostarczenia nam dowodu jej odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej.
Zwrot płatności zostanie dokonany przy użyciu takiego samego sposobu płatności, jaki został użyty przez Państwa w pierwotnej transakcji, chyba że wyraźnie zgodzili się Państwo na inne rozwiązanie.
Towar należy odesłać niezwłocznie, a w każdym przypadku nie później niż 14 dni od dnia poinformowania nas o odstąpieniu od umowy. Termin zostanie zachowany, jeżeli odeślą Państwo rzecz przed upływem 14 dni.
Będą Państwo musieli ponieść bezpośrednie koszty zwrotu towaru.
Odpowiadają Państwo tylko za zmniejszenie wartości rzeczy wynikające z korzystania z niej w sposób wykraczający poza zakres konieczny do stwierdzenia charakteru, cech i funkcjonowania rzeczy.

TERMS AND CONDITIONS OF THE EMILANDIA.PL ONLINE SHOP
1. General Provisions
1.1. The online shop operating at emilandia.pl, hereinafter referred to as the “Shop”, is operated by EMI Barbara Ambrożewicz, conducting business under the name EMI Barbara Ambrożewicz, with the business address: ul. Klonowa 36, 83-330 Lniska, Poland, NIP (Tax Identification Number): 5841382899, hereinafter referred to as the “Seller”.

1.2. These Terms and Conditions set out the rules for using the Shop, in particular the rules for placing orders, concluding and performing sales contracts, making payments and deliveries, submitting complaints, exercising the right of withdrawal, and the rules for providing services by electronic means.
1.3. The Terms and Conditions are made available to the Customer free of charge on the Shop's website in a form that allows them to be obtained, reproduced, saved and printed. The Terms and Conditions are also made available to the Customer before placing an order.
1.4. These Terms and Conditions apply to Customers who are consumers and to businesses making purchases in the Shop.
The provisions concerning consumer rights also apply to a natural person entering into a contract directly related to their business activity, where the content of that contract indicates that it is not of a professional nature for that person, arising in particular from the subject of their business activity.
1.5. The Customer may contact the Seller by e-mail, telephone or in writing using the contact details specified in section 1.1 of these Terms and Conditions.
1.6. Information concerning products published on the Shop's website, in particular product descriptions, photographs and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code, unless the content of a particular piece of information expressly provides otherwise.
1.7. Product photographs displayed in the Shop are for illustrative purposes. Due to the handmade production or hand-decoration of products, individual items may differ slightly from those shown in the photographs, particularly with regard to the arrangement of patterns, ornaments or shades.
2. Services Provided by Electronic Means
2.1. The Seller provides services by electronic means enabling the use of the Shop, including:
a) browsing the Shop's content,
b) using the order form,
c) where such functionality is available – creating and using a Customer account.
2.2. Creating a Customer account is voluntary and is not necessary to place an order, provided that the Seller allows purchases to be made without registration.
2.3. To create an account, the Customer provides the information required by the registration form. The account is provided free of charge for an indefinite period.
2.4. The Customer may cancel their account at any time and request its deletion by sending an appropriate request to the Seller's e-mail address.
2.5. The order form enables the Customer to place orders for products available in the Shop. Use of the order form is free of charge and is a one-time service.
2.6. Use of the Shop requires a device with Internet access and an up-to-date web browser capable of displaying websites correctly. An active e-mail address is also required to place an order.
2.7. The Customer is obliged to use the Shop in accordance with the law, these Terms and Conditions and generally accepted standards of conduct, and in particular not to provide unlawful content or undertake activities that may disrupt the operation of the Shop.
2.8. The Seller informs the Customer that the use of the Internet involves typical risks, such as malware, viruses, attempts at unauthorized access to a device or account, and spam. The Customer should use up-to-date security software and observe basic Internet safety rules.
2.9. Complaints concerning services provided by electronic means may be submitted electronically or in writing using the contact details specified in section 1.1 of these Terms and Conditions.
2.10. The Seller shall consider a complaint concerning services provided by electronic means within 14 days of receiving it and shall inform the Customer of the outcome.
3. Placing Orders and Concluding Contracts
3.1. The Shop allows orders to be placed 24 hours a day, 7 days a week, subject to technical interruptions or other circumstances beyond the Seller's control.
3.2. In order to place an order, the Customer:
a) selects the product and quantity,
b) adds the product to the shopping cart,
c) completes the order form by providing the information necessary to process the order,
d) selects the delivery and payment method,
e) reads the Terms and Conditions and the required information,
f) confirms the order by using a button clearly indicating the obligation to pay, e.g. “Order and Pay”.
3.3. Before placing an order, the Customer receives information about the main characteristics of the product, its price, delivery costs and the total order price.
3.4. Placing an order constitutes an offer to conclude a sales contract for the product or products included in the order.
3.5. After receiving an order, the Seller sends the Customer an e-mail confirming receipt of the order.
3.6. The sales contract is concluded when the Seller sends the Customer an e-mail confirming acceptance of the order for processing, unless the Seller informs the Customer that the order cannot be fulfilled.
3.7. Confirmation of the conclusion of the contract is sent to the Customer at the e-mail address provided by the Customer on a durable medium.
3.8. If the Seller is unable to fulfil all or part of an order, the Seller shall promptly inform the Customer. If the order has already been paid for, the Seller shall refund the payment received to the extent that the order cannot be fulfilled.
3.9. Contracts concluded through the Shop are concluded in Polish.
4. Prices and Payments
4.1. Product prices displayed in the Shop are gross prices and are stated in Polish zloty (PLN).
4.2. The product price does not include delivery costs unless otherwise expressly stated for a particular product.
4.3. Delivery costs are provided to the Customer before the order is placed. The total order value, including the product price and delivery costs, is presented to the Customer before the contract is concluded.
4.4. The product price applicable to the Customer is the price displayed in the Shop at the time the order is placed.
4.5. Available payment methods are presented to the Customer during the ordering process.
4.6. The Seller documents sales in accordance with applicable laws by issuing, as appropriate, a fiscal receipt, invoice or other legally required sales document.
5. Delivery and Order Processing
5.1. Delivery of products is subject to a fee unless otherwise stated for a particular product or order.
5.2. Products are delivered through the carrier or postal operator selected by the Customer from among the delivery methods available in the Shop.
5.3. Delivery is made to the address indicated by the Customer in the order form.
5.4. Deliveries are made within the territory of the Republic of Poland. Customers interested in delivery outside Poland should contact the Seller before placing an order in order to determine whether such delivery is possible and to establish the delivery cost.
5.5. The standard order processing time is 2 to 7 business days, unless a different period is specified for a particular product.
5.6. In the case of products made or prepared to an individual order, the processing time may be longer. Such time will be provided to the Customer before the contract is concluded.
5.7. If the Customer selects a delivery method other than the cheapest standard delivery method available in the Shop, in the event of withdrawal from the contract, the Seller shall refund the delivery cost only up to the amount corresponding to the cheapest standard delivery method offered in the Shop.
5.8. The Seller recommends that the Customer check the condition of the shipment upon receipt. If the shipment is damaged, it is advisable to prepare a damage report with the carrier. Failure to prepare such a report does not limit the Customer's rights under applicable law.
6. Complaints – Lack of Conformity of Goods with the Contract
6.1. The Seller is liable to consumers for a lack of conformity of the goods with the contract in accordance with the provisions of the Act of 30 May 2014 on Consumer Rights.
Since 1 January 2023, the statutory basis for the Seller's liability towards consumers is lack of conformity of the goods with the contract, rather than the statutory warranty (rękojmia).
6.2. Goods conform to the contract if, in particular, they correspond to the description, type, quantity, quality, completeness and functionality specified in the contract and possess the characteristics that a consumer may reasonably expect, taking into account the nature of the goods and public statements made by the Seller.
6.3. If the goods do not conform to the contract, the consumer may submit a complaint and request that the goods be brought into conformity with the contract by means of repair or replacement.
6.4. Where the conditions specified by law are met, the consumer may also request a price reduction or withdraw from the contract. In particular, these rights may apply where the Seller has refused to repair or replace the goods, has failed to bring the goods into conformity with the contract within a reasonable time, or where the goods remain non-conforming. In the event of a material lack of conformity, the consumer may exercise the right to a price reduction or withdrawal from the contract in accordance with the law.
6.5. As a general rule, the Seller's liability for a lack of conformity of goods with the contract lasts for 2 years from the date on which the goods were delivered to the consumer, in accordance with the Consumer Rights Act.
6.6. A complaint may be submitted:
a) in writing to the Seller's address specified in section 1.1 of these Terms and Conditions,
b) by e-mail to: emilandia@emilandia.pl
6.7. A complaint should, where possible, include:
a) the Customer's details,
b) information allowing the order or purchase to be identified,
c) a description of the identified lack of conformity of the goods with the contract,
d) the date on which the lack of conformity was identified,
e) the Customer's request.
Providing the above information is intended to facilitate the processing of the complaint; however, failure to provide such information cannot in itself constitute grounds for refusing to consider the complaint.
6.8. The Seller shall respond to a consumer complaint within 14 days of receiving it. Failure to respond within this period means that the complaint is deemed accepted to the extent and under the conditions provided for by law.
6.9. Where repair or replacement of the goods is necessary, the Seller shall bear the costs associated with bringing the goods into conformity with the contract, including transport, shipping, labour and materials, in accordance with applicable law.
6.10. The Seller does not provide an additional commercial warranty for products unless expressly stated otherwise for a particular product. The absence of a warranty does not limit the Customer's statutory rights arising from a lack of conformity of the goods with the contract.
7. Right of Withdrawal from the Contract
7.1. A Customer who is a consumer and who has concluded a distance contract generally has the right to withdraw from the contract within 14 days without giving any reason, in accordance with the Consumer Rights Act.
7.2. The withdrawal period expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods.
7.3. To exercise the right of withdrawal, the Customer should inform the Seller of their decision by means of an unequivocal statement, for example by post or e-mail.
7.4. The Customer may use the withdrawal form attached to these Terms and Conditions; however, use of the form is not mandatory.
7.5. To meet the withdrawal deadline, it is sufficient to send the withdrawal statement before the expiry of the 14-day period.
7.6. In the event of an effective withdrawal from the contract, the Seller shall refund all payments received from the Customer, including the cost of the cheapest standard delivery method offered in the Shop.
7.7. The refund shall be made without undue delay and no later than 14 days from the date on which the Seller receives the withdrawal statement. The Seller may withhold the refund until the returned goods have been received or until the Customer provides proof of having sent the goods back, whichever occurs first.
7.8. The refund shall be made using the same payment method used by the Customer, unless the Customer expressly agrees to another method of refund.
7.9. The Customer should return the goods without undue delay and no later than 14 days from the date of informing the Seller of the withdrawal. The deadline is met if the Customer sends the goods back before the expiry of the 14-day period.
7.10. The direct cost of returning the goods shall be borne by the Customer unless the Seller has agreed to bear these costs or applicable law provides otherwise.
7.11. The Customer is liable for any reduction in the value of the goods resulting from handling them in a manner beyond what is necessary to establish their nature, characteristics and functioning.
7.12. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to cases specified in Article 38 of the Consumer Rights Act.
In particular, the right of withdrawal does not apply to contracts:
a) concerning non-prefabricated goods made according to the consumer's specifications or serving to satisfy the consumer's individual needs;
b) concerning goods that are liable to deteriorate rapidly or have a short shelf life;
c) concerning goods delivered in sealed packaging which cannot be returned after opening for reasons of health protection or hygiene, where the packaging has been opened after delivery;
d) concerning goods which, after delivery, become inseparably connected with other items due to their nature.
7.13. In the case of products made to an individual order according to the Customer's choice, in particular with regard to colour, pattern, ornament, dimensions or other individual characteristics, the right of withdrawal may be excluded where the product meets the conditions specified in Article 38(3) of the Consumer Rights Act.
Information concerning the exclusion of the right of withdrawal is provided to the Customer before the contract is concluded.
8. Out-of-Court Methods of Handling Complaints and Pursuing Claims
8.1. A Customer who is a consumer may use out-of-court methods of handling complaints and pursuing claims.
8.2. In particular, the consumer may seek assistance from:
a) the competent district or municipal consumer ombudsman,
b) a social organisation whose statutory or constitutional purpose includes consumer protection,
c) the competent regional Inspectorate of Trade Inspection,
d) an authorised entity conducting out-of-court consumer dispute resolution proceedings.
8.3. Detailed information concerning available out-of-court consumer dispute resolution methods is available on the websites of the Office of Competition and Consumer Protection (UOKiK) and the relevant institutions.
8.4. The Seller informs that the European Union's Online Dispute Resolution (ODR) platform has been discontinued. As of 20 March 2025, no new complaints could be submitted through the platform, and the regulation establishing the platform was repealed with effect from 20 July 2025.
9. Personal Data and Privacy
9.1. The controller of Customers' personal data is EMI Barbara Ambrożewicz, ul. Klonowa 36, 83-330 Lniska, Poland, NIP: 5841382899.
9.2. Customers' personal data is processed in accordance with applicable laws, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
9.3. Providing personal data is voluntary; however, providing the data necessary to process an order is required to conclude and perform the sales contract.
9.4. Personal data may be processed in particular for the purposes of:
a) processing orders,
b) concluding and performing sales contracts,
c) processing payments,
d) arranging delivery,
e) handling complaints and returns,
f) fulfilling legal obligations,
g) pursuing or defending against claims.
9.5. Customer data may be transferred to entities cooperating with the Seller to the extent necessary to fulfil an order, in particular courier companies, postal operators, payment service providers and IT service providers.
9.6. Detailed information concerning the processing of personal data, legal bases, data retention periods and Customer rights is provided in the Privacy Policy available on the Shop's website.
10. Provisions Concerning Business Customers
10.1. The provisions of this section apply exclusively to Customers who are not consumers and to businesses to which consumer protection provisions do not apply.
10.2. In the case of business Customers, the Seller may make the processing of an order conditional upon the provision of information necessary to issue a sales document.
10.3. In the case of business Customers, the Seller's liability for lack of conformity of goods with the contract shall be governed by generally applicable laws, taking into account provisions that may apply to the particular type of contract.
10.4. In disputes with a business Customer, the competent court shall be determined in accordance with generally applicable law.
11. Final Provisions
11.1. The Seller respects consumer rights arising from mandatory provisions of law. The provisions of these Terms and Conditions are not intended to exclude or limit any consumer rights granted under applicable law.
11.2. If any provision of these Terms and Conditions is found to be invalid or ineffective, the remaining provisions shall remain in force, and the invalid or ineffective provision shall be replaced by the relevant provisions of law.
11.3. The Seller may amend these Terms and Conditions for important reasons, in particular in the event of:
a) changes in applicable law,
b) changes to payment or delivery methods,
c) changes to the Shop's functionality,
d) the need to clarify provisions of the Terms and Conditions.
11.4. Amendments to the Terms and Conditions shall not affect rights acquired by Customers before the amendments enter into force.
11.5. Contracts concluded before an amendment to the Terms and Conditions shall be governed by the version of the Terms and Conditions in force at the time the relevant contract was concluded, unless applicable law provides otherwise.
11.6. The current version of the Terms and Conditions is available on the Shop's website.
11.7. These Terms and Conditions enter into force on [DATE].
APPENDIX NO. 1
INFORMATION ON THE RIGHT OF WITHDRAWAL FROM THE CONTRACT
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquired possession of the goods or on which a third party other than the carrier and indicated by you acquired possession of the goods.

You may use the model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from the contract, we shall reimburse all payments received from you, including the costs of delivery, except for any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method offered by us.
We shall make the reimbursement without undue delay and, in any event, no later than 14 days from the day on which we were informed of your decision to exercise the right of withdrawal.
We may withhold reimbursement until we have received the goods or until you have provided evidence that you have sent the goods back, whichever occurs first.
We shall make the reimbursement using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise.
You must send the goods back without undue delay and, in any event, no later than 14 days from the day on which you informed us of your withdrawal from the contract. The deadline is met if you send the goods back before the 14-day period has expired.
You will have to bear the direct cost of returning the goods.
You are liable only for any diminished value of the goods resulting from handling them beyond what is necessary to establish the nature, characteristics and functioning of the goods.
